Getting Your Houston Marriage License

You may visit any of our 10 locations to obtain a marriage license. Both parties must have a valid id such as a drivers license, Id card issued by DPS, valid passport, resident alien card, or other government issued identification.

The license fee is $71.00. There is a 72-hour waiting period within the State of Texas. This means the ceremony cannot take place the first 72 hours. The license is valid for 30 days and can be used in any county within the State of Texas.

Effective September 1, 2008, if the bride and groom have completed an 8-hour state-approved premarital counseling program, the license fee is only $11.00, and the 72-hour waiting period is automatically waived. The bride and groom must present the certificate of completion to the clerk.

You do not need to bring witnesses to obtain the Marriage license.

Frequently Asked Qustions

The Bride and Groom need to be 18 years of age or older and should go together to obtain their marriage license. If one person is unable to appear, an Affidavit of Absent Applicant is required. Please call the County Clerk’s office for more information, or instructions and an interactive form is available on the County Clerk's website, cclerk.hctx.net.

No blood tests nor health certificates are needed.

Same sex marriages are not legal in the state of Texas.

The following people are authorized to conduct marriage ceremonies:

Licensed or ordained Christian ministers, priests or Jewish rabbis

Persons who are officers of religious organizations and who are duly authorized by the organization to conduct marriage ceremonies

Justices of the supreme Court, judges of the court of criminal appeals, justices of the court of appeals, judges of the district, county, and probate courts, judges of the county court at law, courts of domestic relations and juvenile courts, retired justices and judges of such courts, justices of the peace, retired justices of the peace, and judges and magistrates of the federal courts of this state.
